Frequently Asked Questions: Criminal Defense

Do I need an attorney?
One reason for initially consulting an attorney is to help you make this decision. An attorney can help you get a clear picture of your situation. The only way to ensure that your rights are fully protected however, is to have an attorney by your side through every step of the process.

What should I do if there is a warrant out for my arrest?
Contact a lawyer. Depending on the situation and charges, your lawyer may arrange for you to surrender yourself for booking or to appear before the Court that issued the warrant. Bail can be arranged ahead of time, if needed.

How long will my criminal case take?
Unfortunatley, there is no right answer to this question. A good offer from the DA could come quickly, but usually, much negotiation is needed. A misdemeanor case that goes to a jury trial could last a year, felonies much longer.

Do I need an investigator?
It depends on what's needed for your particular case. Some witnesses can only be found through investigation, and it's always good to have someone investigating the case besides the police officer. Your lawyer will discuss with you whether or not an investigator is needed, what the costs are, and who is responsible for paying those costs.

Who decides whether my case will go to jury trial?
You decide, with consultation with your attorney, whether your case goes to trial. Everyone accused of a crime has the right to a jury trial. However, most cases are resolved through a plea bargain with the DA.
